Overview

These terms apply when you use the Haskaps of Oz by Yeowarra website or purchase products and services from us. By placing an order, you agree to these terms together with our Shipping Policy, Refund Policy and Privacy Policy. Nothing in these terms excludes, restricts or modifies rights that cannot lawfully be excluded, including rights under the Australian Consumer Law.

Our products

We sell compatible haskap plant packs, plant-care add-ons and grower-support services. Haskap performance depends on cultivar, climate, winter chill, summer heat, soil, water, pollination, care and other site conditions. Growing information is general guidance and is not a guarantee of plant performance, fruit set, yield or commercial return.

Plant photographs show the type and character of our stock but living plants naturally vary by season, growth stage and batch. Pack descriptions state the number of plants and compatible cultivar mix. The exact supplied selections may vary with nursery availability, and the plants and labels included with your order identify what you receive.

Prices and payment

Prices are shown in Australian dollars and include GST unless stated otherwise. Delivery is calculated at checkout. Payment must be authorised before an order is accepted for fulfilment.

Orders and availability

Submitting an order does not guarantee acceptance. We may contact you or cancel and refund an order if stock is unavailable, pricing or product information contains a material error, payment cannot be verified, fraud is suspected, or plant movement rules prevent delivery to the destination. If we cannot supply an accepted order, we will provide the remedy required by law.

Delivery and biosecurity

Delivery is governed by our Shipping Policy. Customers must provide accurate delivery details. Plant movement restrictions can change, and an order may be delayed or cancelled where the destination cannot legally receive the plants.

Website content

We aim to keep product, price and growing information accurate and current. Minor errors may occur. We may update website content, products and availability without notice, but changes will not remove rights that already apply to an accepted order.

Intellectual property

Unless otherwise stated, the website’s text, photographs, graphics, branding and downloadable materials belong to Haskaps of Oz by Yeowarra or are used with permission. They may not be reproduced or used commercially without permission.

Liability

To the maximum extent permitted by law, we are not responsible for indirect loss arising from use of the website or from growing outcomes outside our reasonable control. This limitation does not apply where liability cannot lawfully be excluded or limited.

Governing law

These terms are governed by the laws of Victoria, Australia. Courts and tribunals with jurisdiction in Victoria may hear disputes, subject to any rights you have under applicable consumer law.
